Abstract
Discusses the ECJ's limited and inconsistent approach to moral rights in copyright under the Convention for the Protection of Literary and Artistic Works 1886. Examines how a broader focus reveals the link between the autonomy of moral rights and EU fundamental rights of dignity and privacy. Compares the approach of the UK and Ireland to moral rights and explains the benefits of a dignitarian approach, of harmonisation and possible codification.
