Abstract
Argues that detention powers under the Illegal Migration Act 2023 violate the right to liberty under ECHR art.5. Reviews relevant breaches of protection from arbitrary detention, the lack of judicial oversight, and potential violations of ECHR arts 14, 17 and 18 when read in conjunction with art.5.
