Abstract
Examines how climate change litigation is likely to affect land use and the value of land in the future, applying insights from Resilient Property Theory. Refers to the decision in Verein KlimaSeniorinnen Schweiz v Switzerland (53600/20) (ECtHR), which found that the Swiss government's failure to effectively tackle climate change infringed citizens' ECHR art.8 rights and illustrates the relationships between private property, housing, environmental sustainability and public health and wellbeing.
