Abstract
Ever since the enactment of the European Convention on Human Rights (ECHR), fundamental rights have operated at and between national and EU law. 2 With the enactment of the Charter of Fundamental Rights (the Charter) via, inter alia, Article 67, Title V of the Treaty on the Functioning of the European Union (TFEU), a further layer of fundamental rights has emerged. The Charter addresses the protection of six key rights, one of which is justice.
