Abstract
This article examines the first ruling of the EU General Court on the registration of a sound mark submitted in audio format, in which it was held that the sound of opening a can, followed by a short pause and a fizzing sound, cannot be registered as a trade mark for beverages and their containers. The analysis examines the Court’s reasoning and discusses the decision’s practical significance.
